Terms and Conditions
This document covers the terms of use for SingleFire.Net products and services and represents a non-transferrable agreement between SingleFire.Net and its customers.
DEFINITIONS
Website, web site, site: SingleFire.net, singlefire.net, www.singlefire.net and all associated files and subdirectories.
Company, we, us: SingleFire.Net, Principal(s)
Consumer, customer, client, you, yours, him, his, he, her, hers, she: Individual or organization to whom products and services are being provided.
Products: Final deliverable goods as transferred from SingleFire.Net to the consumer including free templates and completed custom templates.
Services: Creative and delivery services include custom template creation and automated and form-based, brochure interface distribution services.
CUSTOM TEMPLATE PAYMENT & DELIVERY
Initial Payment; Deposit; Start-work
An initial, non-refundable payment or deposit of 50% of the stated service cost is due prior to the start of any project work by SingleFire.Net. Under no circumstances should work done by SingleFire.Net without the receipt of the intial payment obligate the client to partial payment for the work done or full payment for completed work. Nor shall SingleFire.Net under any circumstances be obligated to present partial or completed work to the client at any point without receipt of the initial payment in the amount of 50% of the project cost.
Payment in Full
The client may, at his or her discretion, present the full payment for the project prior to the start of work. In this case the client, if for any reason prior to the delivery of completed work, chooses to revoke or refrain from the completion of the service, he or she will be entitled to a refund of 50% of the full project payment he/she rendered.
Final Payment
Once the client has approved, to his/her satisfaction, the completed work of SingleFire.Net on behalf of the client, the client shall present the remaining payment of 50% of the stated service cost prior to the physical delivery of the completed project assets to which the client is entitled.
Delivery of Assets
Once the final payment is received by SingleFire.Net, the completed physical assets will be provided by SingleFire.Net to the client by email, FTP, CD, or other means as discussed and agreed upon between the two parties.
CUSTOM TEMPLATE USAGE
Custom templates are created on behalf of the client, his/her organization and brand. Custom templates are made available for modification and publication by the customer represented in this agreement only. Any custom template provided to you by SingleFire.Net for which full payment has been rendered is provided exclusively to you and will not be made available for use by other clients of SingleFire.Net. SingleFire.Net does provide a creative service and as such occasional similarities among templates may be observed. SingleFire.Net assures you that any similarities are purely coincidental and we will never duplicate your custom template exactly. SingleFire.Net does reserve the right to use custom templates we have created for our own promotional purposes. Under no circumstances may your custom template be redistributed or sold to a third party without the expressed written consent of SingleFire.Net and its principal(s).
FREE TEMPLATE USAGE
Templates made available through the "Free Templates" portion of this web site are eligible for download at no cost to the consumer. Templates are made available for modification and publication by the customer represented in this agreement only. Under no circumstances may these templates be redistributed or sold to a third party without the expressed written consent of SingleFire.Net and its principal(s).
Free templates are provided "as is", and SingleFire.Net is under no obligation to make modifications, alterations, updates or other requested changes to the free templates. SingleFire.Net may, at its own discretion, make modifications, alterations, updates or other changes to the templates at which point any modified template may replace any previous version of that template. SingleFire.Net shall not be required at any time, unless required by law, to make available any template or template version not presently available through the site.
INDEMNITY
Products and services provided by SingleFire.Net are offered as communication tools for the purpose of improved convenience and efficiency of our clients. The use, modification and publication of the products and services provided is executed at the will of the client.
The client agrees to indemnify, defend, and hold harmless SingleFire.Net and its officers, directors, agents, and employees from and against any and all demands, claims, and damages to persons or property, losses and liabilities, including reasonable attorney's fees, arising out of or caused by your use of the products and services described herein.
